The Amended Enforcement Degree of the Act on Assistance to Patients Suffering from Actual or Potential Aftereffects of Defoliants

The Enforcement Decree of the Act on Assistance to Patients Suffering from Actual or Potential Aftereffects of Defoliants shall be amended as follows:

  • The term "disability ratings" shall be changed to "disability ratings and the amount of allowances to be paid to" in Article 9(1), and Article 9(3) shall be deleted.
  • The term "paragraph (3)" shall be changed to "paragraph (1)" in Article 9(4), and the term "paragraphs (3) and (4)" shall be changed to "paragraphs (1) and (4)" in Article 9(5).
  • The title of attached Table 1, "Table of Disability Ratings for Patients Suffering from Potential Aftereffects of Defoliants (regarding Article 9(1))," shall be changed to "Table of Disability Ratings and Paid Allowance Amounts for Patients Suffering from Potential Aftereffects of Defoliants (regarding Article 9(1))." "1. Table of Disability Ratings for Patients Suffering from Potential Aftereffects of Defoliants" shall be added after the title of the Table, and Appendix 2 shall be added at the end of the Table as follows:

Table of Disability Ratings for Second-Generation Patients Suffering from Actual Aftereffects of Defoliants

Spina bifida, spondylopathy associated with paraplegia

Severe Disorder
  1. 01A person who has paraplegia and has lost the ability to walk
  2. 02A person who cannot voluntarily control urination or defecation
  3. 03A person whose hands and feet have functional or sensory impairments to such an extent that they cannot hold a writing tool, feed themselves, or protect themselves
  4. 04A person whose IQ is 69 or below due to hydrocephalus
  5. 05A person who has lost the function of both arms and legs due to spinal cord injury, excluding external injury, or paralysis due to a nervous system disorder
  6. 06A person who has lost the ability to walk and always requires assistance for urination and defecation due to loss of voluntary control of the lower body
  7. 07A person who has a walking impairment due to loss of voluntary control on either the left or right side of the body
Moderate Disorder
  1. 01A person who depends on prosthetic devices for walking
  2. 02A person who periodically requires medication or catheterization to maintain large intestine function or to assist with urination or defecation
  3. 03A person whose hands and feet have functional or sensory impairments, but who can hold a writing tool, feed themselves, or protect themselves
  4. 04A person whose IQ is from 70 to 89 due to hydrocephalus
  5. 05A person who has severe functional impairment in one arm or one leg due to neural paralysis
  6. 06A person who has a severe malformation or functional impairment due to spinal cord injury, excluding external injury
Mild Disorder
  1. 01A person who can voluntarily control urination or defecation
  2. 02A person whose hands and feet do not have functional or sensory impairments
  3. 03A person who has a mild malformation or functional impairment due to spinal cord injury, excluding external injury

Peripheral Neuropathy

Severe Disorder
  1. 01A person who has severe muscular atrophy or muscle weakness in both arms and legs
  2. 02A person who has lost the function of both arms and one leg, or of one arm and both legs, due to a severe nervous system disorder
  3. 03A person who is permanently unable to work due to a nervous system disorder
Moderate Disorder
  1. 01A person who has severe muscular atrophy or muscle weakness in both arms and both legs
  2. 02A person who has severe muscular atrophies or muscle weakness in both arms and legs
  3. 03A person who is only able to do light work due to a nervous system disorder
  4. 04A person who has severe muscular atrophy or a nervous system disorder in the part of one arm below the elbow or one leg below the knee
Mild Disorder
  1. 01A person who has mild muscular atrophy or muscle weakness in both arms and both legs
  2. 02A person who is partially limited in employment due to a nervous system disorder
  3. 03A person whose palm is paralyzed due to neurological impairment
  4. 04A person who has mild neurological symptoms in a specific body part
