Amendment to the Enforcement Decree of the Act on Assistance, etc. to Patients Suffering from Actual or Potential Aftereffects of Defoliant

The Enforcement Decree of the Act on Assistance, etc. to Patients Suffering from Actual or Potential Aftereffects of Defoliant shall be amended as follows.

  • In Article 9, Paragraph 1, the term “disability rating” shall be replaced with “disability rating and allowance payment amount,” and Paragraph 3 of the same Article shall be deleted.
  • In Article 9, Paragraph 4, the reference to “Paragraph 3” shall be changed to “Paragraph 1,” and in Paragraph 5 of the same Article, the phrase “Paragraphs 3 through 4” shall be amended to “Paragraphs 1 and 4.”
  • The title “Table of Disability Ratings for Patients with Potential Aftereffects of Defoliant (Related to Article 9, Paragraph 1)” shall be amended to “Table of Disability Ratings and Allowance Payment Amounts for Patients with Potential Aftereffects of Defoliant Exposure (Related to Article 9, Paragraph 1).” Immediately after the title of the same Table, the following subheading shall be inserted: “1. Table of Disability Ratings for Patients with Potential Aftereffects of Defoliant.” At the end of the same Table, a new Subparagraph 2 shall be added as follows.

Table of Disability Ratings for Second-Generation Patients with Aftereffects of Defoliant Exposure

Spina Bifida, Paraplegia, and Spinal Lesions

Severe Disability
  1. 01A person whose lower limbs are paralyzed and who has completely lost the ability to walk
  2. 02A person who is unable to control urination and defecation
  3. 03A person whose functional or sensory impairment in the hands and feet is so severe that they are unable to hold a writing instrument, feed themselves, or protect themselves
  4. 04A person whose intelligence quotient (I.Q.) is 69 or below due to hydrocephalus
  5. 05A person who has completely lost the function of both arms and both legs due to spinal injury or paralysis of the nervous system, excluding cases caused by external trauma
  6. 06A person with complete paralysis of the lower body who has entirely lost the ability to walk and who continuously requires assistance for excretion and urination functions
  7. 07A person with paralysis on the left or right side of the body (hemiplegia) that causes impairment in walking ability
Moderate Disability
  1. 01A person who walks with the aid of a prosthetic device
  2. 02A person who requires medication or periodic use of a catheter to maintain urination or bowel function
  3. 03A person who has functional or sensory impairment in the hands or feet but is still able to hold a writing instrument, feed themselves, and perform self-care
  4. 04A person whose intelligence quotient (I.Q.) is between 70 and 89 due to hydrocephalus
  5. 05A person who has severe functional impairment in one arm or one leg due to nerve paralysis
  6. 06A person who has a severe deformity or functional impairment of the spine due to spinal injury, excluding cases caused by external trauma
Mild Disability
  1. 01A person who is able to control urination and defecation
  2. 02A person who has no functional or sensory impairment in the hands or feet
  3. 03A person who has a mild spinal deformity or functional impairment due to spinal injury, excluding cases caused by external trauma

Peripheral nervous system

Severe Disability
  1. 01A person who has severe muscular atrophy and weakness in both arms and legs
  2. 02A person who has completely lost the function of both arms and one leg, or one arm and both legs, due to severe neurological impairment
  3. 03A person who, due to neurological dysfunction, is unable to engage in any form of labor throughout their lifetime
Moderate Disability
  1. 01A person who has severe muscular atrophy and weakness in both arms and both legs
  2. 02A person who has severe muscular atrophy and weakness in both hands and both feet
  3. 03A person who, due to neurological dysfunction, is unable to perform any work other than light labor
  4. 04A person who has severe muscular atrophy or nerve paralysis below the elbow in one arm, or below the knee joint in one leg
Mild Disability
  1. 01A person who has mild muscular atrophy and weakness in both hands and both feet
  2. 02A person who is partially restricted in employment due to neurological impairment
  3. 03A person who has paralysis of the palm due to nerve injury
  4. 04A person who has persistent localized neurological symptoms
