Amendment to the Enforcement Decree of the Act on Assistance to Patients

The Enforcement Decree of the Act on Assistance to Patients Suffering from Actual or Potential Aftereffects of Defoliants shall be amended as follows.

  • In Article 9 (1), the term “disability grade” shall be replaced with “disability grade payment amount,” and paragraph (3) of the same Article shall be deleted.
  • In Article 9 (4), the term “paragraph (3)” shall be replaced with “paragraph (1),” and in paragraph (5) of the same Article, the phrase “paragraphs (3) through (4)” shall be replaced with “paragraphs (1) and (4).”
  • The title of Attached Table 1, “Table of Disability Grades for Patients Suffering from Aftereffects of Defoliants (Related to Article 9 (1)),” shall be amended to “Table of Disability Grades and Payment Amounts for Patients Suffering from Aftereffects of Defoliants (Related to Article 9 (1)).” After the title of the same Table, the phrase “1. Table of Disability Grades for Patients Suffering from Aftereffects of Defoliants” shall be added, and a new subparagraph (2) shall be inserted at the end of the same Table as follows.

Table of Disability Grades for Second-Generation Patients with Aftereffects of Defoliants

Spina Bifida and Paraplegic Spinal Lesions

Severe Disability
  1. 01A person with complete loss of ambulatory function due to paralysis of the lower limbs.
  2. 02A person who has lost control of bladder and bowel function.
  3. 03A person with functional or sensory impairment of the hands and feet to the extent that they are unable to hold a writing instrument, feed themselves, or perform self-care activities.
  4. 04A person whose intelligence quotient (I.Q.) is 69 or below due to hydrocephalus.
  5. 05A person with complete loss of function in both upper and lower limbs due to non-traumatic spinal injury or neurological paralysis.
  6. 06A person with paraplegia who has completely lost the ability to walk and requires constant assistance for urination and defecation.
  7. 07A person with hemiplegia on either the left or right side, resulting in impaired walking ability.
Moderate Disability
  1. 01A person who walks with the aid of prosthetic devices.
  2. 02A person who requires medication or periodic catheterization to maintain urinary or bowel function.
  3. 03A person with functional or sensory impairment in the hands or feet, but who is able to hold a writing instrument, feed themselves, and perform self-care activities.
  4. 04A person whose intelligence quotient (I.Q.) is between 70 and 89 due to hydrocephalus.
  5. 05A person with severe functional impairment in one arm or one leg caused by nerve paralysis.
  6. 06A person with a severe spinal deformity or functional impairment due to non-traumatic spinal injury.
Mild Disability
  1. 01A person who is able to control urination and defecation.
  2. 02A person without functional or sensory impairment in the hands or feet.
  3. 03A person with mild deformity or functional impairment caused by non-traumatic spinal injury.

Peripheral neuropathy

Severe Disability
  1. 01A person with severe muscular atrophy and weakness affecting all upper and lower limbs.
  2. 02A person with complete loss of function in both arms and one leg, or one arm and both legs, due to severe neurological impairment.
  3. 03A person who is permanently unable to engage in any form of labor due to neurological dysfunction.
Moderate Disability
  1. 01A person with severe muscular atrophy and weakness in both arms or both legs.
  2. 02A person with severe muscular atrophy and myasthenia in both hands and both feet.
  3. 03A person who can perform only simple labor due to neurological dysfunction.
  4. 04A person with severe muscular atrophy or nerve paralysis in one arm below the elbow or one leg below the knee joint.
Mild Disability
  1. 01A person with slight muscular atrophy and myasthenia in both hands or both feet.
  2. 02A person who faces partial restrictions on employment due to neurological impairment.
  3. 03A person with palmar paralysis due to nerve injury.
  4. 04A person with persistent localized neurological symptoms.
