Required Documents for Issuance of Medical Record Copies

  • Daegu Veterans Hospital manages all medical records in accordance with the Medical Service Act and the Personal Information Protection Act to protect patients’ privacy and prevent violations of personal rights.
  • When requesting copies of medical records, the applicant’s identity must be verified. Therefore, the patient, family member, or authorized representative must bring the required relationship documents listed below when visiting the hospital.
  • According to Article 21 (2) of the Medical Service Act, no one other than the patient may access or obtain copies of the patient’s medical records.
    However, under Article 21 (3) of the same Act and Article 13-3 of the Enforcement Rule, issuance of copies is permitted when legal requirements are met.

For injury examinations or Agent Orange-related medical records (test results, imaging data), copies can only be issued after the applicant has received the official evaluation results and requests access/copies through the relevant Veterans Affairs Office.

  • Age 17 or older: Resident Registration Card must be issued according to Article 24 (1) of the Resident Registration Act.

Legal Reference: Article 13-3 of the Enforcement Rule of the Medical Service Act

  • Identification: Resident Registration Card, Passport, Driver’s License, or any other valid government-issued photo ID.
  • The Consent Form and Power of Attorney must be completed using the official formats (Form No. 9-2 and 9-3).
  • The Consent Form must clearly state the purpose, date, and scope of consent.
  • The Consent Form and Power of Attorney must include the patient’s handwritten signature only. (Seals or fingerprints are not accepted.)
  • If a minor under 14 applies independently and has decision-making ability (typically age 10 or older), issuance is possible only with a photo ID (Youth ID or Student ID).
  • If the patient has agreed to appoint a sub-representative, the designated family member or representative may apply for copies, but the Consent Form or Power of Attorney must explicitly include the phrase “Sub-representative appointment permitted.”

Common Requirements

  • Copy of the applicant’s ID (e.g., passport, driver’s license, resident registration card)
  • Document verifying family relationship (e.g., family relations certificate, resident registration certificate)

Exceptions: When the patient’s sibling(s) make the request

Documents proving that the patient has no spouse, direct descendants, or spouse’s direct descendants must also be submitted (e.g., documents verifying absence of relatives).

  • Deceased patient: Documents confirming the death (e.g., family relations certificate, death certificate, removal from family register)
  • Unconscious, critically ill, or injured patient: A medical certificate confirming that the patient is unable to provide a handwritten signature due to unconsciousness, serious illness, or injury
  • Missing patient: Documents verifying the patient’s missing status (e.g., resident registration abstract, court-issued missing person declaration)
  • Incapacitated patient: A copy of the court decision declaring legal incompetence or a psychiatric certificate confirming that the patient is legally incapacitated

  • When the patient cannot provide consent, a family member with the right to apply may appoint a representative, and that representative can request a copy of the medical records.
  • If the patient has no spouse, direct descendants, or spouse’s direct descendants, the patient’s siblings may request a copy of the medical records. A family member with the right to apply may also appoint another representative in this case.
  • If the patient consents to the appointment of a representative, the appointed family member or representative may delegate the request for medical record copies to another representative. (The consent form must clearly state: “Appointment of a representative is permitted.”)
